Terms of Service

1. Scope of Services

Novateh LLC provides IT asset buyback, NIST-aligned data sanitization (using professional software or physical destruction), and responsible recycling.

2. Evaluation and Payment Terms

We offer two flexible payment structures depending on the project:

• As-Is Purchase: For many projects, we provide an immediate quote and issue payment upon pickup. In these cases, the sale is final once payment is made.
• Audit & Pay: For complex inventories, we may pickup, audit, and test equipment at our facility before issuing a final offer. If the audit results in a price change, the customer will be notified for approval before the transaction is finalized.

3. Ownership & Transfer of Title

Customers warrant they have legal ownership of all equipment. Title and ownership of the assets transfer to Novateh LLC immediately upon payment or upon physical receipt of the equipment, whichever occurs first.

4. Data Responsibility

While Novateh LLC utilizes industry-standard sanitization processes (such as Blancco or physical destruction), the customer is responsible for backing up any necessary data prior to relinquishing equipment. Novateh LLC is not liable for the loss of data once the destruction process has begun.

5. Condition of Equipment & Batteries

We accept IT equipment and UPS systems in any condition, including devices with degraded or failed batteries. However, Novateh LLC does not accept non-electronic hazardous waste, including but not limited to chemicals, liquids, or bio-hazardous materials.

6. Limitation of Liability

Novateh LLC is not liable for any indirect, incidental, or consequential damages arising from the disposal, data destruction, or recycling process. Our maximum liability is limited to the purchase price paid for the equipment.

7. Governing Law

These terms shall be governed by the laws of the State of Washington.
